Terms and Conditions of Use

These Terms and Conditions govern access to and use of the digital credentials verification platform called Certificados Tecsify (also called Tecsify Verify) (the "Platform"), operated by Tecsify with registered address in Guatemala City ("Tecsify").

By accessing, viewing, or using the Platform, you agree to be bound by these Terms and Conditions.

If you do not agree, you must refrain from using the Platform.

0. Definitions

  • User: Any person who accesses, consults, views, or uses the Tecsify Platform, including, without limitation, certificate holders, employers, educational institutions, external organizations, or any interested third party. Access or use of the Platform, even without prior registration, constitutes full acceptance of these Terms.
  • Platform: Refers to the technological system for storage, viewing, and verification of digital credentials operated by Tecsify.
  • Issuer: Entity responsible for uploading certificate information to the Platform. It may be Tecsify or an authorized external organization.
  • External Organization: Any entity (universities, companies, NGOs, clubs, institutions, or others) that issues certificates through the Platform without being part of Tecsify.
  • Unique Identifier (UUID): Alphanumeric code assigned to each certificate for identification and verification within the Platform.

1. Nature of the service

Tecsify Verify is a technological infrastructure that enables:

  • Digital storage of certificates, diplomas, or recognitions issued by Tecsify or external organizations.
  • Viewing of those credentials through a unique link, QR code, or email search.
  • Technical verification that a record associated with a unique identifier (UUID) exists in Tecsify's database.

The verification performed by the Platform is limited exclusively to confirming that a record exists in the database managed by Tecsify and corresponds to the information uploaded by the issuer.

Technical verification does not constitute academic validation, institutional accreditation, regulated professional certification, or a guarantee of merit.

2. Roles and responsibilities

2.1 When Tecsify acts as Issuer

When certificates correspond to courses, workshops, or activities organized directly by Tecsify, it will act as the issuer and will be responsible for the content of those credentials in accordance with its internal criteria.

2.2 When an External Organization is involved

When certificates are issued by an external organization (universities, companies, NGOs, clubs, institutions, or other entities):

  • The external organization is solely responsible for the certificate content.
  • It is responsible for the accuracy of the information provided.
  • It is responsible for obtaining the necessary authorizations and consents to share data with Tecsify.
  • It is responsible for the academic or institutional validity it assigns to the certificate.

In these cases, Tecsify acts solely as a technological provider of digital storage and visualization.

3. Scope of verification

The verification performed by the Platform:

  • Confirms that the unique identifier (UUID) exists in Tecsify's database.
  • Shows the associated data as uploaded by the issuer.

The Platform does not:

  • Verify the identity of the holder.
  • Verify actual attendance or fulfillment of requirements.
  • Validate signatures.
  • Certify institutional accreditation.
  • Guarantee legal recognition in any jurisdiction.

4. Access and email search

The Platform may allow credential queries by entering an email address.

Anyone performing a search declares that:

  • They have authorization to consult such information.
  • They will use the information exclusively for legitimate purposes.

Tecsify will not be responsible for misuse of the search system when a third party enters an email address without authorization. Credential viewing is limited to the information that the Issuer has determined to be verifiable through the Platform.

5. Responsibility of issuing organizations

Issuing organizations guarantee that:

  • They have the right to use the names, logos, and signatures included in the certificates.
  • They have obtained the necessary authorizations for the processing and publication of personal data.
  • The information provided is truthful and up to date.

Issuing organizations shall indemnify and hold Tecsify harmless against any claim arising from the content or data provided.

This obligation applies regardless of whether the service has been paid for or provided free of charge.

6. Removal or disabling of certificates

Tecsify reserves the right to remove, disable, or suspend any certificate when:

  • It contains false information.
  • It violates third-party rights.
  • There is a legal requirement.
  • There is non-compliance with these Terms.
  • There are justified technical or operational reasons.

Removal or suspension will not give rise to any right to compensation.

7. Personal data

Tecsify may process name, email address, and certificate-related metadata.

When the certificate is issued by an external organization, that organization acts as the data controller, and Tecsify processes the data following its instructions.

Tecsify does not request or verify the age of certificate holders. Issuing organizations are responsible for obtaining the required consents under applicable regulations.

The holder may request deletion of their certificate by sending a request from the email associated with certificados@tecsify.com.

Tecsify does not use personal data for marketing purposes nor does it sell it to third parties.

8. Limitation of liability

In no event will Tecsify be liable for:

  • Indirect, incidental, or consequential damages.
  • Third-party claims arising from the use of the Platform.
  • Misuse by the certificate holder.
  • Damages arising from incorrect information provided by third parties.
  • Misuse of the system by third parties.
  • Technical interruptions outside its reasonable control.

Tecsify's total liability arising from use of the Platform shall not exceed the greater of:

  • The amount actually paid by the issuing organization during the twelve (12) months prior to the event giving rise to the claim, or
  • One hundred U.S. dollars (USD $100).

9. Free service

Tecsify may offer free services to nonprofit organizations, educational institutions, or other entities. When the service is provided free of charge, this does not imply any expansion of Tecsify's liability.

10. Intellectual property

The technological infrastructure, Platform design, and verification system belong to Tecsify.

Logos and designs included in the certificates belong to their respective owners.

11. Prohibitions

It is prohibited to:

  • Perform automated scraping.
  • Attempt to compromise the security of the system.
  • Massively reproduce the content for commercial purposes.
  • Technically manipulate the operation of the Platform.

12. Force majeure

Tecsify will not be responsible for interruptions caused by events beyond its reasonable control, including infrastructure failures, cyberattacks, natural disasters, or government decisions.

13. Modifications

Tecsify may update these Terms at any time.

Modifications will take effect upon publication on the website.

Continued use of the Platform implies acceptance of the modifications.

14. Jurisdiction and governing law

These Terms are governed by the laws of the Republic of Guatemala.

Any dispute shall be submitted to the competent courts of the city of Guatemala.
